Terms and conditions

These terms apply to all services of Bartwerk Barbershops GmbH in all seven shops, and to appointments, cut cards and gift cards bought through this website. The German version is the legally binding one.
§ 1 Scope and contracting party
Your contracting party is Bartwerk Barbershops GmbH, Frankfurter Straße 128, 51147 Köln-Wahn, Germany. Differing terms proposed by the customer do not become part of the contract unless we agree to them in writing.
A consumer for the purposes of these terms is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession.
§ 2 Formation of the contract
The presentation of services on this website is not a binding offer but an invitation to book. By submitting the booking form you make an offer. The contract is formed when we confirm it by email.
For a walk-in visit the contract is formed when the service begins at the chair.
§ 3 Prices and payment
The prices shown on this website at the time of booking apply. All prices are in euros and include statutory VAT. The four core services cost the same in all seven shops; there is no city, weekend or stylist surcharge.
Payment is made in the shop after the service, in cash or by debit or credit card. Cut cards and gift cards are paid for before they are issued.
§ 4 Appointments, lateness and cancellation
Booked appointments start at the agreed time. If you are more than 10 minutes late the service may be shortened or the appointment cancelled so that following appointments start on time; the full price of the booked service remains payable in that case.
Cancellation is free of charge up to 4 hours before the appointment. After that, or if you do not appear, we charge 50% of the price of the booked service as compensation. You remain free to prove that our loss was lower.
§ 5 Performance of the service
We owe a carefully executed service to the Bartwerk standard, not a particular visual outcome. Results depend on hair structure, hair length, growth direction and previous treatments.
Please tell us before we start about allergies, skin conditions or injuries in the treatment area. We do not write such information down; it is taken into account verbally for the current appointment only. We may decline the service where there is a contagious condition in the treatment area.
§ 6 Bartwerk Pass
The Bartwerk Pass is an optional additional service. It records your cut settings and, for as long as you have sharing switched on, is shown to the barber taking your appointment.
The pass does not replace a conversation. You may depart from the stored settings at any time at the chair; what you say before the service begins always prevails. We accept no liability for the accuracy of entries you make yourself. Details of the processing are in the privacy policy.
§ 7 Cut cards
The 10-cut card entitles the holder to ten Bartwerk cuts for the card price of €249. It is valid in all seven shops, is transferable and has no expiry date.
Cash payment of any remaining value is excluded. If a card is lost we can only replace it where it was linked to a customer account.
§ 8 Gift cards
Gift cards are issued for the amount purchased and are valid in all seven shops. They are transferable and do not expire; the start of the statutory limitation period follows § 195 of the German Civil Code.
Gift cards may be redeemed over several visits. Any remaining balance stays on the card and is not paid out in cash.
§ 9 Warranty and rework
If you are not satisfied with the result, contact us within 7 days of the appointment. We will then rework it free of charge in the shop that carried it out.
If the rework fails or is unreasonable to expect, you may reduce the price or withdraw from the contract. Further statutory rights remain unaffected.
§ 10 Liability
We are liable without limitation for intent and gross negligence, and for damage arising from injury to life, body or health.
In cases of ordinary negligence we are liable only for breach of a material contractual obligation, and only up to the foreseeable damage typical for this type of contract. For coats and valuables brought into the shop we are liable only in cases of intent or gross negligence.
§ 11 Shop rules
Children under 12 are served only when accompanied by a parent or guardian who remains in the shop for the appointment.
We reserve the right to refuse service to customers who are significantly under the influence of alcohol or drugs, or who behave abusively towards staff or other customers.
§ 12 Final provisions
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer protection rules of your country of habitual residence remain unaffected.
If any provision is invalid, the validity of the remaining provisions is unaffected. For merchants, the place of jurisdiction is Cologne.
